Acceptable Use Policy.

This Acceptable Use Policy sets out the standards that apply to the use of the Lanced platform, including the Lanced website, applications, artist profiles, media libraries, public pages, network and discovery features, messaging, Talent Rooms and related services.

Acceptable Use Policy

1. Purpose and scope

This Acceptable Use Policy (the "Policy") sets out the standards that apply to the use of the Lanced platform, including the Lanced website, applications, artist profiles, media libraries, public pages, network and discovery features, messaging, Talent Rooms and related services (together, the "Platform").

This Policy applies to all users of the Platform, including:

  • artists and other individual users holding a Lanced account;
  • companies, organisations and other business users;
  • individuals granted access through a company account, including reviewers, jury members, collaborators and Talent Room guests;
  • any person or system accessing the Platform through an interface, integration or application programming interface made available by Lanced.

This Policy forms part of the Lanced Terms of Service and is incorporated into them by reference. By accessing or using the Platform you agree to comply with this Policy.

2. Relationship to other Lanced documents

This Policy sits alongside the following documents. Each governs a different aspect of the relationship between Lanced and its users.

  • Terms of Service — the contractual relationship, including liability, intellectual property, fees and termination.
  • Acceptable Use Policy (this document) — conduct and content standards applying to all users across the Platform.
  • Call Policy — additional requirements applying specifically to auditions, castings, open calls and recruitment processes.
  • Notice, Moderation and Enforcement Policy — how to report content or conduct, and how Lanced reviews reports and applies measures.
  • Privacy Policy — how Lanced processes personal data where it acts as an independent Data Controller.
  • Data Processing Addendum — how Lanced processes personal data as a Data Processor on behalf of a company customer.

Where a conflict arises between these documents, they apply in the following order of priority: the Terms of Service, then the Data Processing Addendum in respect of matters it governs, then this Policy, then the Call Policy, then the Notice, Moderation and Enforcement Policy.

3. General standard

Lanced is a professional platform for the performing arts and entertainment sector. Users are expected to use the Platform lawfully and professionally, to respect other users, and to handle personal data made available to them through the Platform with care.

The examples set out in this Policy are illustrative rather than exhaustive. Lanced may take action in respect of conduct that is harmful, unlawful or materially inconsistent with the purpose of the Platform, even where that conduct is not expressly described below.

4. Accounts, access and platform integrity

You must:

  • provide accurate and current registration information, and keep it up to date;
  • keep your login credentials confidential and notify Lanced promptly if you believe your account has been compromised;
  • ensure that any person you grant access to a company account, including reviewer and jury seats, complies with this Policy.

You must not:

  • share, sell or transfer account credentials or user seats, or permit access by any person other than the individual to whom the seat was allocated;
  • create an account in the name of another person or organisation without authorisation, or misrepresent your identity, role or affiliation;
  • access or attempt to access any part of the Platform, or any data, that you are not authorised to access;
  • circumvent or attempt to circumvent access controls, rate limits, usage limits or technical restrictions;
  • use crawlers, scrapers, bots or other automated means to access the Platform or to collect, copy or index content or personal data, except where expressly permitted in writing by Lanced;
  • reverse engineer, decompile or attempt to derive the source code of the Platform, except to the extent this restriction is prohibited by applicable law;
  • conduct penetration testing, vulnerability scanning or other security testing without Lanced's prior written authorisation;
  • introduce malware or any code intended to disrupt, damage or gain unauthorised access to the Platform or to any user's systems or data.

Suspected security vulnerabilities should be reported to security@lancedhq.com rather than tested further or disclosed publicly. Lanced will not pursue action against a person who reports a vulnerability in good faith, who does not access or alter data beyond what is necessary to demonstrate the issue, and who allows Lanced a reasonable opportunity to address it before disclosure.

5. Content you publish

Users of the Platform publish a substantial amount of their own content, including profiles, biographies, showreels, photographs, audio recordings, written work, credits and personal pages. You remain responsible for the content you publish.

You represent that you hold, or have obtained, the rights necessary to publish the content you upload, including any rights of third parties appearing in or contributing to that content.

You must not publish content that:

  • infringes the intellectual property rights, image rights or personality rights of any person;
  • is unlawful, defamatory, harassing, hateful, or discriminatory contrary to applicable law;
  • depicts a minor in a sexualised, exploitative or otherwise inappropriate manner;
  • depicts a real person by means of synthetic or artificially generated media without that person's consent, or presents such media as authentic without clear disclosure;
  • contains personal data relating to another person where you do not have a lawful basis to publish it;
  • misrepresents a production, organisation, engagement or opportunity, including its existence, funding, terms or the identity of those involved;
  • contains malware or code intended to cause harm.

Nudity and intimate content. Lanced recognises that partial or full nudity forms part of legitimate professional work in dance, physical theatre, film and photography, and does not prohibit it outright. Where such material is published on the Platform it must:

  • have a genuine professional purpose connected to the artist's work;
  • be marked as restricted content using the tools provided, so that it is not displayed by default;
  • relate only to a person aged 18 or over;
  • be published only by, or with the documented agreement of, every identifiable person appearing in it.

Sexually explicit material that does not meet these conditions is not permitted. Companies must not require an artist to submit nude or intimate material as part of an initial application; requirements of this kind are governed by the Call Policy.

6. Public visibility of content

Parts of the Platform are designed to be publicly visible. Depending on the settings applied, profiles, published work and shared call pages may be accessible to people who do not hold a Lanced account, including through links shared by a company and through external search engines.

You should review the visibility settings applicable to your account and content before publishing, and should not publish information that you would not wish to be publicly accessible. You must not publish personal data relating to another person, including a colleague, collaborator or applicant, without a lawful basis for doing so.

Accounts belonging to users under the age of 18 are set to restricted visibility by default and are excluded from indexing by external search engines.

7. Use of personal data of other users

This section applies in particular, but not exclusively, to companies and to individuals accessing the Platform through a company account.

Where the Platform gives you access to personal data relating to another user, including applications, profiles, media, notes, scores, shortlists, talent database records and Talent Room content, you must:

  • use that personal data only for the purpose for which it was made available to you;
  • apply appropriate technical and organisational measures to protect it;
  • respond to requests from individuals exercising their rights under applicable Data Protection Laws in respect of data for which you are responsible.

You must not:

  • use personal data obtained through the Platform for an unrelated recruitment process, for marketing, or for any other purpose not disclosed to the individual, unless you have a lawful basis to do so;
  • sell, rent, licence or otherwise transfer personal data obtained through the Platform to any third party, except as permitted under applicable Data Protection Laws and disclosed to the individual;
  • combine personal data obtained through the Platform with data obtained by scraping or from third-party sources in order to build or enrich profiles of individuals, except where lawful and disclosed;
  • use personal data obtained through the Platform to train, fine-tune or evaluate artificial intelligence or machine learning models, except where expressly agreed with Lanced in writing and lawful in respect of the individuals concerned;
  • retain exported or downloaded personal data for longer than is necessary for the purpose for which it was obtained.

Where you export or download personal data from the Platform, that data leaves Lanced's technical environment and its protection becomes your responsibility. You should apply your own retention schedule, access controls and security measures to it.

Companies act as independent Data Controllers in respect of their own recruitment processes and company-specific records. The restrictions in this section are contractual commitments made to Lanced under the Terms of Service. They are not processing instructions and do not alter the allocation of controller and processor roles set out in the Privacy Policy and the Data Processing Addendum.

8. Sensitive information, self-identification and equal treatment

8.1

General position

You must not request, collect or store through the Platform personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, data concerning health, or data concerning a person's sex life or sexual orientation, except as expressly provided for in this section.

You must not request criminal offence data except where permitted under Article 10 of the General Data Protection Regulation and applicable national law.

You must not request identity documents, financial account details, government identification numbers or similar information through free-text fields, messages or media uploads on the Platform.

8.2

Optional self-identification by artists

Some artists choose to share information about their appearance, heritage or ethnic background, because it is relevant to the roles for which they wish to be considered. Where the Platform offers fields of this kind, they are:

  • always optional, and switched off by default;
  • provided only on the basis of the artist's explicit consent, given separately for storing the information, for showing it to companies, and for allowing companies to filter on it;
  • withdrawable at any time, without affecting the artist's visibility for roles that do not depend on that information.

Artists are under no obligation to complete these fields, and choosing not to do so does not reduce access to the Platform or to opportunities that do not turn on the characteristic concerned.

8.3

Use by companies

Where a role has a requirement relating to appearance, heritage or ethnic background, a company may take that requirement into account only where:

  • the characteristic is genuinely and determiningly required by the specific role, having regard to the nature of the activity or the context in which it is carried out;
  • the aim pursued is legitimate and the requirement is proportionate to that aim;
  • the requirement is stated and explained in connection with a specific call; and
  • it is not used to search or filter the general talent pool outside the context of a specific call.

Lanced restricts searching and filtering on these characteristics to within an active call, requires a role-related explanation to be given at the point of use, and keeps a record of when the feature is used.

Companies remain responsible for the lawfulness of their own selection criteria under applicable equal treatment law. Lanced does not assess or approve a company's selection criteria on its behalf, and the availability of a feature on the Platform does not indicate that any particular use of it is lawful.

9. Minors

Minors participate in the performing arts sector, and the Platform is used in connection with engagements involving performers under the age of 18. The following additional rules apply.

  • The minimum age for holding a Lanced account is 16. An account may not be created for a person under that age.
  • An account for a person aged 16 or 17 may only be created and maintained with the involvement and consent of a parent or legal guardian, whose contact details must be provided and kept current.
  • Companies must not contact a person under 18 outside the workflows provided by the Platform, and must not request private or unsupervised meetings, auditions or communications.
  • Companies must not request images, video or other material from a person under 18 that is revealing, intimate or otherwise inappropriate for a professional recruitment process, and must not request such material as a condition of consideration.
  • Companies are responsible for obtaining any permits, exemptions, authorisations or supervision arrangements required under applicable law in relation to the engagement of performers under 18, and for complying with any conditions attached to them.

Content or conduct that places a minor at risk is treated as the most serious category of breach of this Policy and will be acted on as a priority.

10. Fair dealing and prohibited practices

You must not use the Platform to:

  • charge, or seek to charge, an artist a fee as a condition of applying for, auditioning for or being considered for an engagement;
  • advertise an engagement that does not exist, or that is materially different from the way it is described;
  • harass, threaten, intimidate or direct unwanted sexual attention towards any person;
  • send unsolicited bulk messages or promotional communications contrary to applicable law;
  • move a process off the Platform for the purpose of circumventing the safeguards, records or standards that apply to it;
  • engage in fraud, misrepresentation or any other unlawful activity.

Nothing in this Policy prevents users who have connected through the Platform from communicating or contracting with one another outside it in good faith.

11. Reporting a concern

If you believe that content or conduct on the Platform is unlawful or breaches this Policy, you can report it to Lanced at support@lancedhq.com. Details of what a report should contain, how Lanced reviews reports, and how decisions can be contested are set out in the Notice, Moderation and Enforcement Policy.

12. Enforcement

Where Lanced considers that this Policy has been breached, it may apply one or more of the measures described in the Notice, Moderation and Enforcement Policy, including removing or restricting access to content, restricting visibility, restricting features, suspending an account, or terminating access in accordance with the Terms of Service.

Measures will be applied in a manner that is proportionate to the nature and seriousness of the breach, taking into account the circumstances of the case and whether it is a first or repeated occurrence. Where a measure is applied, Lanced will provide the affected user with a statement of reasons and information on how the decision may be contested, to the extent required by applicable law.

Lanced does not undertake a general obligation to monitor content published on the Platform, and does not review content before it is published. Lanced may nonetheless carry out its own reviews and act on its own initiative where it becomes aware of potentially unlawful content or of conduct inconsistent with this Policy.

13. Changes to this Policy

Lanced may update this Policy from time to time, for example to reflect changes to the Platform, to applicable law or to regulatory guidance. Where a change is material, Lanced will give at least 30 days' notice through the Platform or by email before it takes effect, unless a shorter period is required by law or is necessary to address a legal or security risk.
